Koster files briefs in Supreme Court healthcare case

JEFFERSON CITY, Mo. – Missouri’s Attorney General has weighed in on the healthcare reform cases headed to the Supreme Court.

Chris Koster announced Tuesday that he has filed amicus briefs with the high court supporting a multi-state effort to have the individual mandate provision of the Affordable Care Act declared unconstitutional. But unlike many other attorneys general driving the case, Koster does not feel the entire bill should be overturned as a result.

Koster’s stance mirrors the ruling made by the 11th circuit court of appeals last year.

“This has been a challenging decision, but ultimately one that must be decided on the law alone,” Koster said. “I do not believe the Commerce Clause can be used by Congress to force consumers into a market unwillingly.”

The Affordable Care Act cases are currently pending in the Supreme Court.
